Terms and Conditions

Effective Date: August 10, 2026

These Terms and Conditions (“Terms”) apply to the website and services provided by Campman Fencing LLC (“Campman Fencing,” “Company,” “we,” “us,” or “our”).

By using our website, approving an estimate, signing a proposal or agreement, paying a deposit, or authorizing us to begin work, you agree to these Terms and any project-specific terms included in your written agreement.

1. Our Services

Campman Fencing provides residential and commercial property-improvement services in Tyler and surrounding East Texas communities.

Our services may include:

  • Wood fencing
  • Ornamental iron fencing
  • Aluminum fencing
  • Chain-link fencing
  • Residential fence installation
  • Commercial fence installation
  • Pergola construction
  • Drainage solutions
  • Fence replacement and related services
  • Other work described in an approved proposal

The exact scope of work, materials, pricing, payment requirements, and project specifications will be stated in the customer’s written estimate, proposal, or service agreement.

3. Project Approval

Work may be scheduled after the customer:

  • Approves the proposal or estimate
  • Signs any required agreement
  • Provides requested project information
  • Pays any required deposit
  • Completes any other stated project requirements

If these Terms conflict with a signed project agreement, the signed agreement will control for that specific project.

4. Pricing and Payment

Project pricing and payment terms will be provided in the approved proposal or agreement.

A deposit may be required before materials are ordered or work is scheduled. The remaining balance must be paid according to the agreed payment schedule.

The customer is responsible for approved additional work and costs resulting from requested changes, inaccurate information, undisclosed property conditions, or work outside the original scope.

Overdue balances may be subject to collection costs and other charges permitted by the signed agreement and applicable law.

5. Scheduling and Delays

Start and completion dates are estimates unless expressly guaranteed in writing.

The schedule may be affected by:

  • Weather
  • Material availability
  • Supplier or delivery delays
  • Permit or inspection delays
  • Utility-marking delays
  • Site and soil conditions
  • Customer-requested changes
  • Customer-caused access delays
  • Events outside our reasonable control

We will provide reasonable notice when a significant scheduling change occurs.

6. Property Access

The customer must provide safe and reasonable access to the project area during scheduled working hours.

Before work begins, the customer should remove or secure:

  • Vehicles
  • Outdoor furniture
  • Decorations
  • Personal belongings
  • Animals
  • Other items that may obstruct or endanger the work

Campman Fencing is not responsible for delays caused by unsafe, restricted, or unavailable site access.

7. Property Boundaries and Customer Responsibilities

The customer is responsible for identifying and confirming the correct property boundaries.
The customer must disclose known:

  • Boundary markers
  • Easements
  • Deed restrictions
  • Private utility lines
  • Irrigation systems
  • Septic systems
  • Underground wiring or piping
  • Drainage systems
  • Homeowners’ association requirements
  • Other conditions that may affect the project

We may recommend a professional survey when property boundaries are unclear. If the customer proceeds without a recommended survey, the customer accepts responsibility for problems caused by inaccurate or unconfirmed boundary information.

8. Utilities and Underground Conditions

Public utilities should be properly located and marked before digging begins.

The customer is responsible for identifying private utilities and systems not covered by public utility-location services.

Campman Fencing is not responsible for damage involving undisclosed, inaccurately located, or unmarked private utilities.

Unexpected conditions—including rocks, roots, buried materials, unstable soil, excessive moisture, or hidden structures—may require additional labor, materials, charges, or scheduling adjustments.

9. Permits, Codes, and Approvals

Fence, pergola, drainage, pool-barrier, commercial, and other projects may be subject to local codes, zoning rules, permits, inspections, easements, or homeowners’ association requirements.

Responsibility for obtaining permits or approvals will be stated in the project agreement.

Unless otherwise agreed in writing, the customer is responsible for:

  • Providing accurate property information
  • Disclosing applicable deed restrictions
  • Obtaining homeowners’ association approval
  • Confirming that the requested project is allowed on the property
  • Providing surveys or other required documents

Regulations vary by city and project type and may change over time.

10. Materials and Natural Variations

Fence and construction materials may have natural or manufacturing variations in:

  • Color
  • Grain
  • Texture
  • Dimensions
  • Finish
  • Appearance

These normal variations are not considered defects.

Wood may naturally expand, contract, split, check, warp, fade, or change color because of weather, moisture, age, and environmental conditions.

If an approved material becomes unavailable, we will discuss reasonable alternatives with the customer before making a material substitution.

11. Changes and Additional Work

Changes to the original project scope must be approved by Campman Fencing and the customer.

Changes may affect:

  • Project pricing
  • Material requirements
  • Payment terms
  • Start date
  • Completion date

Whenever reasonably possible, we will notify the customer before completing additional work that may result in extra charges.

12. Final Inspection and Completion

Upon completion, the customer should inspect the work and notify Campman Fencing promptly of any visible concern.

Minor corrective or warranty work does not automatically delay the project’s completion date or the customer’s payment obligations unless otherwise stated in writing.

13. Warranty

Any workmanship or material warranty will be described in the customer’s proposal, agreement, or separate warranty documentation.

Manufacturer warranties may apply to certain materials and products.

Unless otherwise stated in writing, warranties do not cover damage or changes caused by:

  • Misuse, abuse, or neglect
  • Improper maintenance
  • Unauthorized repairs or modifications
  • Accidents or impact
  • Animals or pests
  • Landscaping or construction performed by others
  • Severe weather, flooding, fire, or natural disasters
  • Soil movement, erosion, or drainage conditions
  • Natural characteristics of wood
  • Normal wear and tear
  • Circumstances outside our reasonable control

14. Cancellation

Cancellation and refund terms will be stated in the approved proposal or agreement.

If a customer cancels after approving a project, the customer may be responsible for:

  • Work already completed
  • Materials already purchased or ordered
  • Custom or nonreturnable materials
  • Supplier cancellation or restocking charges
  • Permit or administrative costs
  • Other project expenses already incurred

15. Limitation of Liability

To the fullest extent permitted by applicable law, Campman Fencing’s responsibility for a verified workmanship or service issue will be limited to correcting the affected work or providing another reasonable remedy.

We are not responsible for delays, damages, or costs resulting from:

  • Inaccurate customer information
  • Unconfirmed property boundaries
  • Undisclosed site conditions
  • Unmarked private utilities
  • Customer or third-party actions
  • Government or homeowners’ association requirements
  • Events outside our reasonable control

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

20. Dispute Resolution and Governing Law

Campman Fencing and the customer agree to first attempt to resolve disputes through good-faith communication.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any unresolved dispute will be handled in an appropriate court with jurisdiction over Campman Fencing’s principal place of business, unless the parties agree otherwise in writing or applicable law requires another venue.

21. Changes to These Terms

We may update these Terms to reflect changes to our website, services, or legal obligations.

Revised Terms will become effective when published with an updated effective date. Updates will not replace the terms of an existing signed project agreement unless both parties agree in writing.

22. Severability

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with the approved proposal, signed agreement, Change Orders, and incorporated policies, form the agreement between Campman Fencing and the customer concerning the applicable services.

24. Acceptance
